Mental health legislation has recently been significantly reformed in most Australian jurisdictions. The new orientation is to go some distance toward implementing the Convention on the Rights of Persons with Disabilities as well as the United Nations Principles for the Protection of Persons with Mental Illness and the Improvement of Mental Health Care. In addition, an attempt has been made to intrude the concept of ‘recovery’ as a rationale and culture underpinning the provision of mental health services. The idea of recovery is about the journey, rather than the outcome, given that a cure for mental illness is often not possible. It is about optimising choice, opportunity and wellbeing during a person’s life with an illness and thus is highly individual.
